Aoife Daly, Ph.D., Trinity College Dublin, is Senior Lecturer in Law at the School of Law and Social Justice and the European Children’s Rights Unit at the University of Liverpool. She writes, teaches and advocates extensively on children’s rights.

During this seminar Rebecca Thorburn Stern will present the study in which she analyses how CRC state parties describe their implementation of Article 12 on respect for the child’s views. The book includes one study of State party reports and CRC Committee Concluding Observations more generally, and one more in-depth country study of Sweden. The focus of the analysis is on if, and in such case how, state parties to explain their actions and inactions when implementing this key right use references to traditional attitudes. It is shown that “traditional attitudes” are employed less as justification of poor implementation than as a way of allocating responsibility to the population rather than to the state party, and that references to tradition remain a mainly non-Western phenomenon, thus also overlooking the impact of traditional attitudes in Western societies.
